Welcome to Verse Fitness. These Terms of Service (“Terms”) are a contract between you and Momentum Growth Partners, LLC, which operates Verse Fitness. By signing up for our daily emails or using our website, you agree to these Terms.

1. The Service

Verse Fitness provides one short daily email at 6am (your local time) containing a New Testament Bible verse and a simple fitness tip. The website also offers access to today's content, articles, and related resources. We aim to offer inspiration and general wellness ideas—not medical, legal, or spiritual advice.

2. Not Medical or Professional Advice

The fitness tips and content on Verse Fitness are for general inspiration and information only. They are not a substitute for professional medical advice, diagnosis, or treatment. Always check with your doctor or healthcare provider before starting any new exercise or diet. If you have a medical condition or concerns, seek advice from a qualified professional. Momentum Growth Partners, LLC and Verse Fitness are not responsible for any injury, loss, or harm resulting from your use of our content or suggestions.

3. Account and Conduct

When you sign up, you provide a valid email address and, if you choose, your first name. You agree to keep your information accurate and not to use Verse Fitness for any unlawful or abusive purpose. You must not attempt to interfere with our systems, other users, or the availability of the service.

4. Unsubscribe

You may unsubscribe at any time using the “Unsubscribe” link in every email or by contacting us. We will process your request promptly and stop sending daily emails. Our Privacy Policy explains how we handle your data after you unsubscribe.

5. Intellectual Property

The content, design, branding, and materials on Verse Fitness (except for Scripture, which we do not claim to own) are owned by Momentum Growth Partners, LLC or our licensors. You may view and use the site for personal, non-commercial use. You may not copy, modify, distribute, or create derivative works from our content or code without our prior written permission.

6. Disclaimer of Warranties

Verse Fitness IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Momentum Growth Partners, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF VERSE FITNESS OR THESE TERMS. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.

8. Indemnification

You agree to indemnify and hold harmless Momentum Growth Partners, LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of Verse Fitness, your violation of these Terms, or your violation of any third-party rights.

9. Changes to the Service and Terms

We may change or discontinue features of Verse Fitness at any time. We may also update these Terms. We will post revised Terms on this page and update the “Last updated” date. Your continued use of the service after changes constitutes acceptance. If you do not agree, please unsubscribe and stop using the site.

10. General

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Any dispute shall be resolved in the state or federal courts located in Texas. If any provision is held invalid, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right.
